Boston man, 28, charged with taking upskirt photo of 11-year-old

A Dorchester man is facing a charge of indecent assault and battery on a person under 14 after he allegedly took an “upskirt” photo of an 11-year-old girl last month.

At the suspect’s arraignment this week, a judge ordered Agustin Jaramillo, 28, held on $500 bail. He is due back in court Sept. 24 for a pre-trial hearing.

The charge stems from an incident on June 6 in which Boston police received a report from a student at Conservancy Lab Charter School in Dorchester, according to a release from the Suffolk County District Attorney’s office.

The student told police that a man — later identified as Jaramillo — approached her as she was walking to a bus stop that morning, handed her a cord, and asked her to help him tie a knot. He then allegedly bent down, told the girl he was going to pull up her sock, and used his cellphone to take a photo up her skirt before rubbing his hand against her leg.

The girl described the man as being in his 30s with a mustache, wearing a black t-shirt and white shorts, and carrying a white plastic shopping bag.

Police reviewed video footage from several cameras in the area of the incident, and saw a man matching that description interact with the victim on Wainwright Street.

After distributing still photos of the suspect to the public, investigators received a tip identifying the man as Jaramillo on June 27. They issued an arrest warrant two days later.

“This young girl deserves great credit for relaying to school officials what happened to her that morning,” Suffolk County District Attorney Kevin Hayden noted in a statement. “That information, along with valuable assistance from a community member, helped police make an identification and arrest. This is yet another example of the community working with law enforcement to increase safety for all.”
